The ordinance approved Oct. 8 includes a limited health care exception, while state policies address energy costs, resource reporting and agreements with host communities.
HACKETTSTOWN, NJ – Hackettstown has adopted an ordinance prohibiting data centers throughout the town’s zoning districts, citing electricity demand, water use, noise and infrastructure concerns.
WRNJ reported that the Town Council approved the ordinance Oct. 8. The town’s official agenda for that meeting identifies Ordinance 2026-11 as an amendment designating data centers a nonpermitted use in every zone and schedules its public hearing and final adoption.
The ordinance covers facilities primarily used to store, manage and process electronic data, along with supporting infrastructure. It includes an exception for facilities primarily serving the internal operations of licensed health care facilities or providers, provided they do not operate commercial data-processing or colocation services for unaffiliated entities.
Town officials cited potential demands on electric and water systems, noise from cooling equipment and generators, and emergency-response needs as the rerasoning behind the ban. The ordinance takes effect following passage and publication as required by law.
The local action follows several state measures adopted this year to regulate data center development and its costs. On Aug. 27, Gov. Mikie Sherrill signed S3379/A4096, requiring owners and operators to submit semiannual reports to the BPU detailing energy and water use.
Those disclosures are intended to show total electricity consumption, energy used for cooling and information technology equipment, peak daily water use, water sources, and on-site and backup power supplies, according to the governor’s announcement.
An earlier law, P.L. 2026, c. 32, signed July 7, directs the BPU to establish a separate ratepayer class and standards for large data center customers. The Department of Community Affairs’ Aug. 25 guidance says the law requires cost-allocation rules intended to prevent other utility customers from subsidizing those facilities’ energy use and associated grid infrastructure.
That guidance also addresses how municipalities can evaluate proposed projects and negotiate community benefits agreements, legally binding contracts between developers and host communities. It recommends examining water and wastewater capacity, utility upgrades, fire protection, emergency response and potential noise and light impacts, with input from residents and other local stakeholders.
The DCA says municipalities generally are not required by statute to pursue such agreements, although specific state incentive programs carry their own requirements. The state offers technical assistance to communities evaluating proposals and negotiating agreements.
